In March last year the U.S. Department of Justice Criminal Division updated guidance for prosecutors as regards their Evaluation of Corporate Compliance Programs. That guidance steers away from ticking-boxes, as we count off inputs into compliance regimes, and towards assessing the outputs these compliance systems produce.1
