Observations

In an op-ed published in the Financial Times earlier this week, Paul Atkins, Chair of the US Securities and Exchange Commission (SEC), argues that the foundation of US capital markets is trust, and that regulators have strayed from the principles that sustain it.

Atkins asserts that the SEC’s mandate should be anchored in materiality, requiring disclosures only when they are relevant to a reasonable investor’s financial decisions. He contends that the agency had engaged in “mission creep” by pursuing broader objectives. "The government should provide the minimum effective dose of regulation needed to protect investors while allowing businesses to flourish," he writes.
